In order to fulfill its main and secondary obligations under employment law, Upgradeyourjob.de uses a mobile application as an "extended arm" of the existing employee management software Zvoove to collect all relevant data. This is defined within the framework of these terms and conditions as expertum JobAPP powered by Zvoove work from the provider Zvoove (formerly Landwehr Software GmbH, hereinafter referred to as "processor").

The use of the APP is recommended or offered by the employer and data protection is ensured along the lines of the data categories and processing procedures defined under 2. “Applicant and contact management”.
The JobAPP is used to process data within the scope of the following functions. In doing so, parts of the data categories defined under 2 may be processed.
Time recording (including hour recording and transmission, time account, vacation requests (follows) and sick notes)
Wage documents (from 2021, including payroll and social security reports)
Communication with the branch via encrypted SSL connection
Furthermore, each employee is informed in a sufficient and reasonable manner about the scope of functions, at least in text form, when the employment relationship is established and/or the first pay slip is issued. With regard to the technical operation and systemic processing, the aforementioned processor within the meaning of Art. 26 GDPR is also (jointly) responsible. This applies in particular to the independent processing operations of the technical transmission of the time records required to carry out the employment relationship via the necessary "location determination" of the temporary worker for the purpose of legally compliant recording. In addition, the contract data processor is jointly responsible for the legally compliant data provision of usage data, the processing and the import of this data.

The legal basis for data processing via the JobAPP is Section 26 Para. 1 BDSG.
If the data processed via the JobAPP is no longer required for the purpose of carrying out the employment relationship (“employee leaves”), there are no other retention or proof obligations to the contrary, or the user chooses a different method of data transmission and has indicated this permanently or repeatedly, the data will be deleted.
All further information and rights (information, objection, etc.) follow from Section 4, which concerns the joint data processing operations with regard to use via the expertum JobApp.
2.2.5. Data protection information - Former employees - Retention and recovery management at expertum
We have decided to introduce the process of “recovery management” for the purpose of “staying in touch” with employees who have left and possible reintegration and acceptance (“re-establishment” of an employment relationship) into the expertum Group and the companies defined under 1. You can join this process by finally agreeing to an invitation from a recruiter or HR consultant electronically (“confirm storage now”) or by declaring your consent to this at least in text form.
If you have expressly and voluntarily given us your consent to do so, you will receive information on further participation in employee discount programs, industry news, potential jobs and employer branding at regular intervals (weekly, monthly and up to one year* after leaving or ending your employment contract). The selection of topics and information areas is at the reasonable discretion of the expertum Group. The process is partially automated via the central, electronic applicant management system (BMS for short) described under 2.2. Only the personal and communication data required to achieve the purpose are used.
Without prejudice to your consent given above, which you can revoke at any time as part of each individual contact, you are entitled to the legal rights described under 5.
*The process of “staying in touch” usually lasts up to one year after initial or repeated contact and explicit consent, unless a new employment relationship is established within this period.*
